Acceptance

By accessing swisspay.ai, submitting an application, or using our payment services, you agree to these terms. If you are entering into them on behalf of a business, you confirm you are authorized to bind that business.

The service

SwissPay provides a routing layer and merchant account services that direct card and alternative payments to acquiring partners suited to your business and risk profile. Approval, pricing and available features depend on underwriting by our acquiring partners and on your business category and history.

Eligibility and merchant obligations

You must provide accurate, complete information during onboarding and keep it current. You are responsible for operating a lawful business, complying with the rules of the card networks and acquirers, maintaining acceptable chargeback and fraud levels, and meeting any documentation or compliance requests.

Acceptable use

You may not use the service for activity that is illegal in the markets you operate in, that breaches card network rules, or that is prohibited by an acquiring partner. We may suspend or decline processing where a business or transaction falls outside what our partners will support.

Fees

Fees are set out in your commercial agreement and depend on your category, volume and risk profile. Applicable processing, interchange and scheme fees may pass through from the card networks and acquirers.

Disclaimers

The service is provided on a commercially reasonable basis. We do not guarantee approval by any specific acquirer, uninterrupted processing, or any particular business outcome. Routing and acquirer availability can change.

Limitation of liability

To the extent permitted by law, SwissPay is not liable for indirect, incidental or consequential losses, or for lost profits, revenue or data. Nothing in these terms limits liability that cannot be limited by law.

Termination

Either party may end the relationship in line with the commercial agreement. We may suspend or terminate service where required by an acquirer, a regulator, or the card networks, or where these terms are breached.
