Terms of Service
These terms govern your use of SwissPay.ai and our services. By applying for or using our services, you agree to them.
Acceptance
By accessing swisspay.ai, submitting an application, or using our payment services, you agree to these terms. If you are entering into them on behalf of a business, you confirm you are authorized to bind that business.
The service
SwissPay is a PayPal-managed payment facilitator. We board and underwrite merchants in-house and provide card and PayPal-wallet payment processing on PayPal's rails, with settlement in USD to your own bank account. You do not need a PayPal account. Approval and available features depend on our underwriting review of your business, its category and its history.
Eligibility and merchant obligations
You must provide accurate, complete information during onboarding and keep it current. You are responsible for operating a lawful business, complying with the rules of the card networks and PayPal, maintaining acceptable chargeback and fraud levels, and meeting any documentation or compliance requests.
Acceptable use
You may not use the service for activity that is illegal in the markets you operate in, that breaches card network or PayPal rules, or that falls in a category we do not accept. We may suspend or decline processing where a business or transaction falls outside what we or PayPal will support.
Fees
Fees are set out in your commercial agreement with SwissPay.
Disclaimers
The service is provided on a commercially reasonable basis. We do not guarantee approval, uninterrupted processing, or any particular business outcome.
Limitation of liability
To the extent permitted by law, SwissPay is not liable for indirect, incidental or consequential losses, or for lost profits, revenue or data. Nothing in these terms limits liability that cannot be limited by law.
Termination
Either party may end the relationship in line with the commercial agreement. We may suspend or terminate service where required by PayPal, a regulator, or the card networks, or where these terms are breached.
